How to apply for an Occupation Order

An application is made to the court using the form FL401 with 3 copies.

An application can be made urgently and ‘ex-parte’. This usually requires the applicant turning up at court with the application and handing it in requesting that it is heard that day. However, such an ex-parte order is very exceptional as it could make a person homeless, without first hearing their position.

An evidential statement with any evidence needs to be submitted with the application.
