I had not seen my child for over a year, and despite a Cafcass recommendation for there to be a fact finding and a report, we were able to convince the judge with sound argumentation to dispense with fact finding, have the social worker do a S7 report to cut length of time and have supervised contact in a contact centre in the interim. Despite being a lawyer by profession, I have no previous experience in the family court. Dan Wilson has been fantastic. My natural instincts were to defend myself and prove every single allegation made by the mother to be false. After reading my allegations against the mother and my reply to the mother's allegations, Dan simply advised that I withdraw my allegations and avoid giving the mother's allegations credibility by defending each and every single one. Dan pointed out that best thing I could do was to reduce conflict and he pointed out that dealing with allegations in an adversarial way only increases conflict. I must say that it felt like a leap of faith withdrawing my allegations and only focusing on some of the mother's allegations ---- and it paid off, ---- it was decided no finding of fact hearing was necessary,'

Position Statement for Child arrangements court hearing

I needed help with writing a good position statement as decided to self represent due to wasting so much money on solicitors and barristers during my case. I contacted Dave Barma after initially seeing the YouTube video for McKenzie Friends. Phil was really helpful from start, definitely has in depth understanding about how the family court operates. A few times I had some last minute emergency submissions and I always felt his support; he even helped on a weekend with a really short notice. One thing I really have to highlight is Phil's honesty, which was sometimes harsh, but that was what prepared me for various potentialities, and prevented from wasting my time on aspects that courts are absolutely not interested about. NB. Had a different independent Mc Kenzie friend initially and he was not even half as good as Phil plus not transparent about the costs, let me down several times with deadlines, not easily accessible for days. I did cope, with her help and expertise but most importantly, the warmth that I needed at a time when I felt the most vulnerable and alone. Solicitors bills have left me in debt but without Michelle I would of been a further £25K in debt as well. I can’t thank her enough and would urge you to contact Michelle if you are struggling with divorce and children related issues.
Michelle is knowledgeable, capable and calm and sat through hearings with me quietly giving me advise and prompts in my earpiece during the hearings. I can’t express enough how much this helped and I simply could not of done this without her.
She read through complicated forms and interpretated them to me and wrote out superb statements without causing aggression and unnecessary conflict.
I wholly believe going through solicitors will cause more harm, money and heartache and wished I had of used Michelle earlier on in the process.

I thought this module was excellent. The case was explained very thoroughly and is probably very typical of many cases in the courts so it was really helpful to see how it progressed.

It might be useful to add as an additional section, some other common scenarios. Not in the detail that was done with the other case but just some common features.

After struggling with a divorce which wasnt easy then after I though the dust had settled I had to deal with an impending custody court case. I found Phil's videos on YouTube to immensly helpful and were exactly what I was looking for in terms of learning what the process involved, how it all works and how to deal with it. I started to understand a lot more and it opened my eyes to a process that was unknown and frankly daunting.
